- individual hairstyles;
- other related hairdressing services described on the site.
The services offered may vary according to the style chosen, the length and type of hair, the time required for completion, and the materials and accessories used.
Article 5.
The information about services, goods and vouchers published on the site, including photos and sample looks, is of an illustrative nature. The specific result of a service depends on the condition and characteristics of the hair, the selected model and compliance with the maintenance instructions - this does not exclude the Merchant's responsibility for good faith and quality performance.
Prices are stated in euros. The indicated price "from" is an initial indicative price; the final type of service, the required materials and the final price are specified and accepted by the Client before assuming a payment obligation. Additional service or expense is due only after separate consent of the Client.
Before the final confirmation of a reservation or order, the Customer is shown the amount due and applicable costs. The display of a free time or availability of a product on the site does not constitute a guarantee of availability until the request is accepted by the Merchant.
In the event of a clear technical or factual error in price, description or availability, established before acceptance of the order, the Merchant shall notify the Customer without undue delay and offer the correct terms. If the Customer does not accept the correction, the order shall not be executed and any amount received shall be refunded. After acceptance of the order, the Merchant shall not unilaterally change the agreed price.
IV. REGISTERING AND CONFIRMING A SERVICE APPOINTMENT
Article 6.
Registration for a service is made through the reservation system or contact form on the website, or through another communication channel specified by the Merchant.
When sending a request, the User provides the necessary information, including:
- two names;
- contact telephone number;
- e-mail;
- preferred day and time;
- selected service;
- additional information necessary to perform the service.
The client is responsible for the accuracy of the data provided and the accessibility of the specified contact channels.
Article 7.
Sending a request through the site constitutes an inquiry and does not automatically mean the conclusion of a contract for the provision of a service. The automatic acceptance of the form and the notification of payment received certify the relevant technical actions, but do not in themselves constitute acceptance of the reservation by the Merchant.
The service contract and the commitment for the specific time arise after successful payment of the due deposit and explicit confirmation by the Merchant to the email or phone number specified by the Customer. Before confirmation, the Merchant may request clarification of the service, the condition of the hair and the time required.
If the request is not accepted, the Merchant shall notify the Customer and refund any amount received under it without undue delay to the original payment method, unless the Customer has expressly accepted another.
V. DEPOSIT AND PAYMENT FOR SERVICES
Article 8.
To confirm the reservation, a deposit of a fixed amount of 50 euros, regardless of the selected service, but not more than the agreed price of the service. The amount of the deposit is shown to the Client before finalizing the reservation.
For services requiring pre-ordering of materials (e.g. Twisters), an additional condition may apply, which the Client will be notified of in advance upon registration.
Article 9.
The deposit represents a partial payment under the contract concluded between the parties, which is deducted from the final price of the service upon the visit. The parties expressly agree that the deposit has the nature of advance payment and does not constitute a deposit within the meaning of Art. 93 of the Obligations and Contracts Act (OCA). The consequences of cancellation, no-show or refusal of the reservation are comprehensively regulated by Section VI below, and not by the general rules of Art. 93 OCA.
When the deposit covers the entire cost of the service, no additional payment is due. In other cases, the balance is paid upon completion of the service.
Article 10.
The available online payment methods and the total amount due are displayed before the payment is made. The merchant does not require payment card details to be sent via contact forms or email - payments are processed only through a certified payment operator.
A failed or interrupted payment does not confirm a reservation. If a refund is required, the rules of this section and applicable law apply.
VI. CHANGE OF TIME, CANCELLATION AND NO-SHOW
Article 11.
AUEXX Braids does not offer the option to change the date or time of an already confirmed reservation. If a different date or time is needed, the Client should cancel the existing reservation in accordance with this section and make a new reservation.
The Customer may cancel a confirmed appointment through the contacts specified in Art. 2. The request is effective upon receipt by the Merchant. The period under this section is calculated in hours backward from the confirmed date and time of the service.
Art.11.1.
Health status and allergies
The Customer is obliged to inform the Merchant in advance about: allergies; scalp sensitivity; skin or health problems. The Merchant is not responsible for adverse reactions when the Customer has not provided the necessary information. In case of suspicion of a health risk, the Merchant has the right to refuse the performance of the service.
Article 12.
Upon cancellation, received at least 72 hours before the start of the service, including right at this limit, the deposit is fully refunded.
When the cancellation notice is received after this deadline for a reason for which the Client is responsible, the Client owes an agreed penalty under Art. 92 of the Obligations and Contracts Act in the amount of the paid deposit. The penalty secures the reserved time and the preparation for the service; the paid deposit applies to its payment and no additional amount is due above it.
Article 13.
In case of non-appearance of the Client or delay of more than 30 minutes, due to which the service cannot objectively be performed in the remaining time, the penalty under the previous paragraph shall apply, if the Client is responsible for the reason. No more than one penalty shall be charged for one reservation.
In the event of systematic no-shows, the Merchant reserves the right to refuse future reservations or require full advance payment for the service.
Article 14.
When the Merchant cancels a reservation after the expiry of the period above for a reason for which it is responsible, the Merchant shall refund the deposit paid to the Customer. In the event of an earlier cancellation by the Merchant, the amount paid for the unperformed service shall be refunded in full, and the Customer shall retain his other legal rights.
When the service cannot be performed for a reason for which neither party is responsible (including extraordinary circumstances within the meaning of Section XVII), the payment shall be refunded in full and no penalty under this section shall be due.
This section does not limit the statutory right to withdraw from a distance contract under Section X. No penalty shall be due under this section upon valid exercise of this right.
VII. ONLINE STORE AND PURCHASE OF PRODUCTS
Article 15.
The online store provides Users with the opportunity to purchase products presented on the site. For each product, a description, main characteristics, price, availability (where applicable) and delivery terms are provided.
Article 16.
Order is placed through:
- product selection;
- add to cart;
- filling in the necessary data;
- choice of delivery method;
- choice of payment method;
- order summary check and confirmation.
Before final shipment, the Customer has the opportunity to check the type and quantity of the goods, the delivery address, the total price and applicable costs and to correct any errors.
Article 17.
The automatic confirmation of a received order does not constitute acceptance of the Customer's offer. The purchase contract is considered concluded after explicit confirmation by the Merchant, sent to the specified telephone or e-mail. In the event of a refusal due to lack of availability, obvious error or objective impossibility, the Customer shall be notified promptly and the amounts paid shall be refunded without undue delay.
VIII. PRICES AND PAYMENT METHODS
Article 18.
All prices of products and services published on the website are indicated in euros and include all applicable taxes and fees, unless expressly stated otherwise.
The merchant reserves the right to change the prices of the products and services offered, and the changes do not affect already confirmed orders or booked services.
Article 19.
Payments for products purchased through the online store can be made through:
- payment by bank card through a secure payment system;
- bank transfer;
- cash on delivery via courier, when this option is available;
- other methods specified on the website.
Article 20.
Payments for services may be made by advance payment of a deposit, advance payment of the full cost of the service, or another method agreed upon between the parties. If advance payment is required, the User will be informed before confirming the registration.
Payment transactions are processed through certified payment operators in accordance with applicable security standards.
Article 20a.
1. Payments with debit and credit cards on the website are made through a virtual POS terminal (V-POS) provided by a servicing bank or a licensed payment operator.
2. Payments are accepted with Visa and Mastercard debit, credit and business cards.
3. Transactions are carried out through the secure VISA Secure and Mastercard Identity Check security programs, which provide cardholder authentication according to the requirements for strong customer authentication (SCA).
4. When making a payment, the User may be redirected to a secure page of the payment operator or bank, where he enters his card details.
5. The merchant does not store bank card data used for payments through the website.
6. All card payments are processed in accordance with Visa, Mastercard security standards and applicable European legislation.
7. If it is necessary to return an amount paid with a bank card, the amount will be refunded to the card with which the payment was made.
IX. DELIVERY OF PRODUCTS
Article 21.
The merchant delivers the purchased products through selected courier services or other methods specified when placing the order.
Article 22.
Delivery time depends on product availability, selected delivery method and order processing. Standard delivery time is up to 5 working days from the acceptance of the order, unless the specific offer provides for another deadline. In case of delay, the Merchant shall notify the Customer and perform within the deadline under the applicable law.
Article 23.
The risk of accidental loss or damage to the goods passes to the Consumer upon actual receipt of the goods by him or by a person designated by him other than the carrier. Handing over to a courier chosen by the Merchant does not in itself transfer the risk in advance.
Upon receipt of the shipment, the Consumer should check the integrity of the packaging, the conformity of the received products with the order and the presence of visible damage, and notify the Merchant as soon as possible - the lack of immediate notification does not take away the legal rights in case of non-conformity.
Article 24.
The Merchant is not responsible for delivery delays caused by courier operators, incorrectly provided delivery details, absence of the User or unforeseeable circumstances beyond the control of the Merchant. In the event of re-delivery due to an incorrect address or non-acceptance of the shipment for a reason for which the Customer is responsible, only the actually incurred and previously notified costs may be claimed.
X. STATUTORY RIGHT TO WITHDRAW FROM A DISTANCE CONTRACT
Article 25.
The consumer generally has the right to withdraw from a distance contract without reason within a period of 14 days. For a service, the term begins from the conclusion of the contract, and for a product - from its receipt by the User or a person designated by him. Booking a hairdressing service for a specific date does not in itself exclude this right.
The right is exercised by an unambiguous statement to the Merchant at auexx.braids@gmail.com or at the address under Art. 2. The User may use the template in Appendix 1 to these terms and conditions, but is not obliged to do so - it is sufficient for the statement to be sent before the expiry of the period.
Article 26.
If the User explicitly requests the performance of a service to begin during the withdrawal period and subsequently withdraws, the Merchant may only receive a proportional part of the agreed price for what was actually provided up to the notification, provided that the legal prerequisites are met.
The right to refuse a service shall lapse after its full performance only if the performance has begun with the prior express consent of the User and with confirmation that he is aware that he will lose the right after full performance. Partial performance in itself does not lead to loss of the right.
Article 27.
If the purchase of a product is cancelled, the User shall send it back or hand it over to the address specified in Art. 2 without undue delay and no later than 14 days after notification. The direct costs of return shall be borne by the User, if this was communicated before the order. The User shall be liable for any diminished value only in the event of use other than that necessary to establish the nature, characteristics and functioning of the product.
The trader shall refund the amounts received, including the cost of standard delivery, without undue delay and no later than 14 days after notification of the withdrawal, using the same payment method, unless the consumer has expressly agreed to another one.
Article 28.
The consumer is informed that the services for making individual hairstyles and braids are personalized services, tailored to the specific wishes and characteristics of the customer. The statutory exceptions to the right of withdrawal only apply if the prerequisites are met - in particular, the exception for sealed goods that are unsuitable for return for health or hygiene reasons after unsealing does not automatically apply to all cosmetic products or hair materials.
XI. COMPLAINTS AND GUARANTEE OF CONFORMITY
Article 29.
The Trader is liable for any non-conformity of the goods that existed upon delivery and became apparent two years A lack of conformity that becomes apparent within one year of delivery is presumed to have existed at that time, unless the contrary is proven or this is incompatible with the nature of the goods or the lack of conformity.
In the event of non-conformity of the goods, the Consumer may request repair or replacement, except when the chosen method is impossible or would impose disproportionate costs. Price reduction or termination of the contract shall apply under the conditions provided for by law.
Article 30.
The consumer has the right to file a complaint in the event of: a product received that is different from the one requested; missing parts or accessories; a defect; non-compliance of the product with the description, or non-compliance of a service provided with the agreement.
Complaints can be sent via:
- e-mail: auexx.braids@gmail.com;
- phone: 0897332303;
- the site's contact form.
When submitting a claim, the User provides details of the purchase/reservation and a description of the problem; proof of purchase is not limited to an original receipt.
Article 31.
In the event of non-conformity of a service, the Consumer exercises his rights separately from the regime for goods. The Trader may request reasonable assistance in reviewing the result and offers legally permissible removal, price reduction or other remedy as appropriate.
In the event of a justified complaint, the Merchant does not transfer to the Consumer any costs that the law assigns to the Merchant.
XII. GIFT VOUCHERS
Article 32.
The online store offers gift vouchers with declared values of 100, 150 and 200 euros or another selected amount. The customer provides data about the sender and recipient and chooses an electronic voucher or a physical card.
The electronic voucher is sent to the specified email after successful payment and acceptance of the order. The physical card is delivered by the method selected during the order; applicable shipping costs are displayed before payment.
Article 33.
The voucher is valid for 12 months from the date of issue and can be used for services in the salon. In case of a service with a higher price, the Client pays the difference. The unused balance can be used for a subsequent reservation within the validity period.
The voucher is presented with a valid code or other identifier specified at the time of issuance. The merchant may refuse reuse of already redeemed value and request reasonable verification in case of suspected abuse, without collecting unnecessary personal data.
Article 34.
In the event of a lost code, the Customer shall promptly notify the Merchant. If the unused value can be identified and protected against re-redemption, the Merchant shall assist in replacing the code.
The voucher is not exchangeable for cash at the holder's discretion, except where a statutory right of refusal, cancellation or refund applies. The terms of validity and use do not exclude the mandatory rights of the User.
XIII. AUEXX BRAIDS ACADEMY
Article 35.
Submitting an application through the AUEXX Braids Academy form constitutes an inquiry and does not reserve a place nor create an obligation to pay tuition.
Admission to training, the program, the schedule, the price, any contributions and the rules in case of absence or termination are expressly regulated before the conclusion of the training contract. In the case of a distance contract, Section X above applies, as long as the legal prerequisites are met.

The messages sent to the contact details provided by the Client serve to authenticate the request and the correspondence thereon; their content may be challenged with admissible evidence, and a technical record in itself is not indisputable evidence against the Client.

The Merchant may restrict technical access in the event of reasonable suspicion of misuse, to the extent necessary and proportionate. The measure does not delete any contractual or statutory rights of the Customer that have already arisen.
Article 44.

Article 45.

There may be minor differences between the visual representation and the actual product, related to device settings, display characteristics or manufacturing features - this does not constitute a product non-conformity.
XVII. LIABILITY OF THE PARTIES AND FORCE MAJEURE
Article 46.
The Merchant takes reasonable care to keep the information on the Site up-to-date, accurate and accessible, but does not guarantee continuous technical availability. Temporary technical interruptions, errors, delays or access restrictions may occur.
The Merchant is not liable for damages resulting from improper use of the site, incorrect data provided by the User, actions of third parties, interruptions caused by internet service providers, or force majeure circumstances. Braiding and hairstyle services are performed individually according to the client's wishes and hair specifics. Before performing the service, the Merchant may request additional information regarding the length, type and condition of the hair, the desired style and the availability of additional materials or accessories.
When hair or scalp characteristics, determined by professional assessment on site, make the agreed technique unsuitable or create a significant risk, the Merchant may offer a safe alternative, a new appointment or refuse the specific technique. A new price or service shall only be applied after the Client's consent.
Article 50.
The final price of the service may depend on the complexity of the selected model, the time required for execution, the amount of materials used and additional wishes of the client. In case of a change in the requested service, the Merchant notifies the client in advance.
Article 51.
The Client undertakes to appear at the agreed day and time, to provide accurate information and to assist in the selection of appropriate technique and materials. The difference between an illustrative photo and the result, determined by the natural characteristics of the hair, is not in itself a discrepancy and does not deprive the Client of rights in the event of poor quality performance.
The merchant may terminate service in the event of threatening behavior, violence, or significant obstruction of work, without this justifying a discriminatory refusal or withholding of amounts beyond what is legally due.
